Rule 10
Arrangements for withdrawing funds
(1) A non-resident Nepali who wants to withdraw the amount of investment made in Nepal and the amount equal to the profit received from it in accordance with Section 9 of the Act shall submit an application to the Secretary by attaching the following details and documents:-
(a) Copy of approval taken for investment as per the Act,
(b) The decision made by the Board of Directors of the concerned company or organization regarding withdrawal of investment,
(c) Copy of tax payment certificate,
(d) The last audited balance sheet up to the financial year preceding the financial year in which the refund application is made,
(e) A copy of proof of payment of debt or liability of any person or institution,
(f) Name, branch and address of the bank used to withdraw the amount,
(G) An affidavit of payment that there is no payment of any kind of revenue or any other obligation to be paid to anyone in Nepal.
(2) If an application is received in accordance with sub-rule (1), the secretary will give approval to repatriate an amount equal to the profit received from such investment in full or in part in case of investments made by non-resident Nepali in convertible foreign currency in Nepal at one time or several times and subject to the law.
